However, you have the absolute right to opt out of these data-sharing “sales,” as detailed in the next section.

If you are a Colorado resident, the Colorado Privacy Act (CPA) provides you with specific rights regarding your personal data. Ni Market is committed to honoring these rights and providing you with accessible tools to exercise them.2
Your Rights Under the Colorado Privacy Act
The CPA grants you the following rights:
- The Right to Access: You have the right to confirm whether we are processing your personal data and to access that data.
- The Right to Correction: You have the right to correct inaccuracies in your personal data, taking into account the nature of the data and the purposes of the processing.
- The Right to Deletion: You have the right to request the deletion of your personal data. Please note that this right is subject to certain exceptions. For instance, we may need to retain certain information to complete the transaction for which the data was collected, comply with our legal obligations (such as for tax and accounting purposes), or to detect security incidents. This is particularly relevant for our wholesale customers, as we must maintain transactional records for business and legal reasons.
- The Right to Data Portability: You have the right to obtain a copy of your personal data in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another entity without hindrance.
- The Right to Opt-Out: You have the right to opt out of the processing of your personal data for purposes of:
(i) targeted advertising;
(ii) the “sale” of personal data;
or (iii) profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.

To protect your privacy and security, we will take reasonable steps to verify your identity before processing your request. This verification process may require you to provide information that we can match with the information we have on file for you, such as your name, email address, and phone number associated with your account. You will not be required to create a new account to submit a request.11
We will respond to your request within 45 days of receipt. If we need more time (up to an additional 45 days), we will inform you of the reason and the extension period in writing.
Exercising Your Right to Opt-Out
You can opt out of the “sale” of your personal data and targeted advertising at any time.
- Privacy Choices Link: Click the “Your Privacy Choices” link in the footer of our website. This will take you to a settings page where you can easily manage your preferences and opt out.
- Universal Opt-Out Mechanism (UOOM): We are committed to honoring opt-out preference signals sent via a Universal Opt-Out Mechanism, such as the Global Privacy Control (GPC). If we detect a GPC signal from your browser, we will automatically treat it as a valid request to opt out of the “sale” or sharing of your data for targeted advertising for that browser.
Processing of Sensitive Data
The CPA provides special protections for “Sensitive Data,” which includes personal data revealing racial or ethnic origin, religious beliefs, a mental or physical health condition or diagnosis, sex life or sexual orientation, or citizenship status. We do not process your sensitive personal data without first obtaining your explicit, opt-in consent.
For example, while you may purchase products like traditional medicinal herbs (thuốc bắc), we will not use that purchase information for secondary purposes, such as inferring a health condition for targeted advertising, without your express permission.
The Right to Appeal
If we deny your request to exercise a right, we will provide you with an explanation for our decision. You have the right to appeal our denial. The notification of denial will include instructions on how to submit an appeal. If your appeal is also denied, we will provide you with information on how to contact the Colorado Attorney General’s Office to submit a complaint.
Data Security and Retention
Our Security Measures
We have a duty of care to protect your personal data. We implement and maintain reasonable administrative, technical, and physical security measures designed to protect the information we collect from unauthorized access, use, disclosure, alteration, or destruction. These measures include practices like data encryption and access controls. However, no security system is impenetrable, and we cannot guarantee the absolute security of your information.
Data Retention
We retain your personal information only for as long as is necessary to fulfill the purposes for which it was collected. This includes providing you with our Services, managing our business operations, complying with our legal and regulatory obligations (e.g., for tax and financial record-keeping), resolving disputes, and enforcing our agreements.
